These terms cover your use of Dellingr — the chat-driven site and web-app builder at dellingr.dev. By creating an account or using the service you agree to them.
They're written in plain English, not legalese. If something here seems unfair or unclear, email support@dellingr.devand we'll sort it out.
1. The service
Dellingr lets you describe a business, upload documents, and have an AI build and deploy a website or web app on your behalf. The service includes:
- Site generation via Anthropic's Claude models
- Deployment to Cloudflare Pages (static sites) or Cloudflare Pages + GitHub + Supabase (web apps)
- Chat-based edits, analytics, administrative tools
We don't guarantee a specific uptime. We try hard — but this is a product under active development, and outages happen. See the Refunds policy for what we do when they do.
2. Your account
- You must be at least 18 years old (or old enough to enter a contract where you live).
- One person, one account. Share access via the team feature instead of sharing a login.
- Keep your password secure. If it's compromised, change it immediately via the Billing tab or the forgot-password flow.
- We monitor for abnormal sign-ins (e.g. logins from different countries within hours). If we spot one, we'll email you.
3. Model actions and pricing
Dellingr meters AI usage in "model actions." One model action roughly equals one AI-powered task (a full site build is 4–6 actions, a single edit is 0–1 actions). Deterministic edits like link retargets and head metadata cost zero model actions.
- Trial: 3 days of full access, 10 starter model actions, 1 company. You can upgrade any time during the trial (even minutes after signup) and the new plan's monthly allowance kicks in immediately. At day 3, if no plan was chosen, your site goes read-only — nothing is deleted; you can still pick a plan and resume.
- Paid plans: Starter $29/mo (20 actions, 1 site), Pro $49/mo (60 actions, 3 sites, all 5 templates + AI Business Partner), Studio $99/mo (200 actions, 10 sites, white-label). See pricing for the full grid.
- Commercial tier is enquire-only — pricing depends on volume and includes BYOK Anthropic mandatory.
- Unused model actions stay on your balance until used — they aren't zeroed out at the monthly refill, the next month's allowance is added on top.
- Failed tasks refund their model action automatically — you only pay for work that produced a result.
4. What you own, what we own
You own everything your Dellingr account produces. That includes every generated site, every piece of copy, every CSV, every database. To export your data, email privacy@dellingr.dev and we'll prepare a GDPR-style JSON dump within 30 days. Self-serve export is on the roadmap.
We own the platform— the code, the templates, the chat framework, the prompts. You don't get a licence to resell or reverse-engineer Dellingr itself. You can sell the sites you build with it; that's fine.
5. Your responsibilities
Don't use Dellingr to:
- Build sites that violate any law — spam, phishing, illegal content, infringing content, malware, CSAM.
- Scrape or load-test services without permission.
- Impersonate other people or businesses.
- Abuse the API to burn our Anthropic budget — we rate-limit and flag suspicious patterns.
If we detect abuse we may pause your account, refund recent payments, and email you an explanation. Persistent abuse = account termination and, in extreme cases, referral to authorities.
5a. Content ownership & IP warranty
For everything you put on a Dellingr-built site — text, images, product photos, logos, names, brand marks, audio, video, uploaded documents — you warrant that you either:
- Own the rights yourself, or
- Have a valid licence to use the content for the purpose of publishing it on the site we build.
AI-generated content (logos, copy, images produced by Anthropic or any tool we route through) is yours under the upstream provider's terms — but you're still responsible for not instructing us to generate something that copies a third party's protected work (e.g. "build a site that looks exactly like Apple's").
5b. Indemnity for IP claims
You agree to indemnify Dellingr and its operators (FQCI) against any third-party claim, demand, loss, or cost (including reasonable legal fees) arising out of:
- Content you uploaded, asked us to generate, or otherwise put on a site we built for you (including business names, brand marks, product photos, copy, and AI-generated assets).
- Allegations that this content infringes a third party's intellectual-property rights — copyright, trademark, design rights, trade dress, publicity rights.
- Allegations that the business name or domain you chose conflicts with an existing registered or unregistered mark.
We'll let you know promptly if a claim arrives, and we won't settle it without your input where the law allows. If a court orders us to remove content or stop using a name, we'll comply — that doesn't affect this indemnity.
5c. Optional name & trademark clearance check
Before we build, Dellingr offers an optional clearance check — domain availability, ASIC business-name lookup (Australia), IP Australia trademark search, USPTO trademark search, EUIPO trademark search, and a common-law web sweep — followed by a plain-language risk assessment. Cost is a small number of model actions (typically 2). It's not legal advice, but it catches the obvious conflicts.
If you choose to skip the clearance check, we record that decision against your company record (timestamp + acknowledgement text) and proceed to build. By skipping, you confirm that:
- You've done your own clearance work, or you're knowingly accepting the risk that the name, domain, or content may conflict with someone else's rights.
- Section 5b (the indemnity) applies in full to any clearance issue that surfaces later.
Running the check doesn't guarantee no conflicts exist — it relies on public databases that are themselves incomplete, and unregistered (common-law) marks may not appear anywhere. We give you the best signal we can for the price; final clearance is always your responsibility.
5d. Acceptable use policy
Some content and use cases are out of scope for Dellingr — full stop, no negotiation. If your site or your use of the platform falls into one of the categories below, we'll suspend your account while we review and permanently terminate it if the violation is confirmed. Suspension keeps your data intact; termination doesn't.
These rules exist for two reasons: (1) we're hosted in Australia and the platform has to comply with Australian law (Online Safety Act 2021, Privacy Act 1988, the relevant state criminal codes, the ACL); (2) Cloudflare, Stripe, Anthropic, Resend and the other infrastructure we sit on each have their own AUPs that pass through to us — what their AUP forbids, ours forbids.
You may not use Dellingr to build, deploy, host, promote, or operate:
- Illegal content.Anything illegal under the law of Australia, your country, or your customers' countries. This includes but is not limited to fraud, deceptive trade practices, market manipulation, terrorism financing, sanctions evasion.
- Hate, harassment, or threats. Content that incites violence, dehumanises, or targets a person or group based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic. Doxxing or publishing private information without consent falls under this category.
- Copyright, trademark, or other IP infringement. Content (text, images, logos, fonts, audio, video) must be yours, properly licensed, or in the public domain. Repeated infringement complaints (DMCA, ASIC, IP Australia) result in permanent termination — see also §5a.
- Malware, phishing, or scams. Sites designed to deceive visitors, harvest credentials, distribute malicious code, or impersonate other businesses.
- Sexually explicit content. Adult / porn / pornographic services. Stripe Connect blocks adult content at the payments layer regardless; we block at the platform layer too.
- Regulated goods without licensing. Sale of firearms, ammunition, weapons, recreational drugs, vape products to under-18s, prescription pharmaceuticals, tobacco, gambling services without the applicable Australian (or local) licence on display.
- Spam and fake-engagement infrastructure. Mass automated outreach without lawful basis (Spam Act 2003), fake review networks, follower/like farms, scraped contact lists.
- Content directed at children under 13.Not without verifiable parental consent and a privacy posture that meets COPPA / GDPR-K equivalents. The free-and-easy path doesn't cover children's sites.
- Building a competing AI website builder ON TOP of Dellingr.If you want to leave and take a copy of your own site's code (which you can — see §4 and the /escape-velocity page), great. If you want to white-label Dellingr's chat surface or scrape it to train a competitor, no — pick a different tool.
What we do when we find a violation:
- First contact — admin suspends the account (sites stay up, data stays intact, login refused) and emails the account holder with the specific issue and a chance to respond.
- If resolved — admin unsuspends, sites and access return as they were.
- If confirmed or unresolved within 14 days — account and every site under it are permanently deleted (Cloudflare Pages, GitHub repo, Supabase project, DB rows). Model actions are not refunded for the period a violation was active.
- For active threats (live malware, active fraud, active CSAM, active doxxing) — immediate permanent termination without the 14-day window. Reports are made to the eSafety Commissioner / ACCC / NCMEC where the law requires it.
Reporting a site you think violates this policy: email abuse@dellingr.dev with the URL and a one-line description. We log every report and review within 48 hours.
6. Third-party services
Dellingr sits on top of other services. When you use Dellingr you're indirectly using:
- Anthropic — for AI generation
- Cloudflare Pages — for hosting generated sites (static + web app), DNS, and SSL certificates
- Cloudflare Turnstile — bot challenge on signup, login, and password-reset forms (when configured). No PII sent — the widget hands us a one-time token Cloudflare verifies.
- GitHub — for code repos (web apps)
- Supabase — for databases (web apps)
- Stripe — for billing (Dellingr's subscription) and per-customer Stripe Connect (your sales)
- Resend — for transactional email
Each service has its own terms. We pass your data to them only to provide the service you asked for. We don't sell data.
7. Changes and cancellation
You can cancel your subscription any time from the Billing tab. Cancellation takes effect at the end of your current billing period — no pro-rata partial refunds unless the Refunds policy says otherwise.
We may update these terms. Material changes get an email notice. Continuing to use the service after the effective date means you accept the new terms.
8. Liability
We're a small team building in good faith. We're not liable for indirect losses, loss of business, or consequential damages. If we somehow manage to owe you money through some bizarre chain of events, our total liability is capped at what you paid us in the last 12 months.
This does not remove rights you have under the Australian Consumer Law — where that law gives you stronger protection, that protection applies.
9. Governing law
These terms are governed by the law of New South Wales, Australia. Disputes go to the courts of NSW.
